RESOLUTIONS OF CEC Meeting of OMSA held at redcross bhawan, bbsr on 21.03.2011

 

Resolution No.1 - It is resolved unanimously to pass the resolutions starting from No.1 to 4 of the last Central Working Committee (CWC) meeting of OMSA held on 21.2.11 at Bhubaneswar.

 

Resolution No.2 - It is resolved unanimously to request all members of OMSA to wear Black Badge from 18th April, 2011 onwards to protest against Govt.’s apathy towards implementation of OMSA’s legitimate demands. After 15 days of wearing Black Badges, if demands are not fulfilled, the members are requested to resort to Relay Hunger Strike.

 

Resolution No.3 - It is resolved unanimously to instruct Branch Secretaries to sensitize their respective members and hold Press Conference regarding OMSA demands in the line of 24.01.11 Press Conference of OMSA held by CEC dated 24.01.11.

 

Resolution No.4 - It is resolved unanimously to form one Legal Aid Fund & Committee of OMSA comprising members Dr. D.K. Guru, Dr. Sanjib Mohapatra, Dr. Sugyanendra Mishra, Dr. P.K. Acharya, Dr. Bijay Mahapatra, Dr. Gurudas Mohapatra, Dr. Subhransu Parida to deal with all legal matters pertaining to association related activities.

 

Resolution No.5 - It is resolved unanimously to collect Rs.500 (Rupees Five Hundred Only) by Cheque from each member of OMSA towards Legal Aid Fund.

 

Resolution No.6 - It is resolved unanimously to collect Rs.100 (Rupees One Hundred Only) from each member by Cheque every month for 2 yrs towards construction of OMSA Bhawan to fulfil a long cherished dream.

 

Resolution No.7 - It is resolved unanimously to elect Dr. Subhransu Sekhar Parida, Branch Secretary-cum-Treasurer, Nilgiri Branch as CWC member in place of Dr. Bhabani Shankar Bal, who expressed his unwillingness on personal ground.

I express my sincere thanks from the core of my heart for your continued support to OMSA’s 35 months old movement aimed to bring about reforms in Govt. Health sector so that young Allopathic doctors of the state love to serve in 1700 Govt. Health Institutions, 80% of whom are in rural Orissa, thereby people of the state 70% of whom live in rural Orissa and 47% below poverty line (Tendulkar report) are not deprived of basic health treatment. The basic problem of Govt. Health services in Orissa is gross shortage of Allopathic doctors which at present may be around 2000 physically doing the duty, whereas there is a need of more than 12000 Allopathic doctors to provide adequate emergency health services to a population of nearly 4.5 crores. Similarly, the basic problems for young Allopathic medicos not joining or leaving shortly after joining to Govt. Health Services is due to lack of Promotion (DACP), Transparent Transfer Policy and Cadre rules.

Acting on the appeal and assurance to examine and implement DACP (Dynamic Assured Career Progression with virtual promotion at the end of 4th, 9th, 13th & 20th years of continuing service) as quickly as possible by the Hon’ble Chief Minister of state, OMSA postponed its movement on 18th April, 2010. On 18th December, 2009, Govt. assured OMSA to examine and implement DACP within 3 months i.e. within 17th March, 2010. Health & FW Deptt. on 25th March, 2010 came out with a notification to constitute a committee of ministers of Health & FW, Finance and Law to examine various aspects of DACP and practice followed in others states and submit its reports at an early date. Just before the deadline of 18th April, 2010, OMSA Executives were irrationally transferred to far off places without policy and promotion to break the moral of the members. Unfortunately, OMSA’s demand for implementation of DACP which would have benefitted the doctors and the people of the state was not taken in true spirit. In the meantime DACP, which has been examined thoroughly by panel of experts before its implementation by the Central Govt. in November, 2010 and a host of other states of Indian Union for its Doctors & Dental Surgeons. With a past track record of uncertain promotional avenues, barely a single promotion in entire service career, no young Allopathic doctor having a brilliant academic career will choose to pursue a career in State Govt. Health Services. With this scenario,

nothing is heard about DACP till now even after a lapse of 9 months since 18th April, 2010. Young Allopathic medicos of the state in the meantime, choose to pursue their career in Central Services, other states and Public Sector units where DACP has been implemented. Those who have joined to State Govt. service recently, left for the better prospects as implementation of DACP became uncertain.

Hon’ble Chief of the state of Orissa declared on 17th March, 2008 in the floor of the Assembly to formulate a Transparent Transfer Policy within 2 months with inputs from OMSA, which is a far-cry now. Without formulating a Transparent Transfer Policy, 174 doctors were transferred in April, 2010 without a promotion. Non formulation and implementation of Transparent Transfer Policy has discouraged the young Allopathic medicos to join to Govt. Health service as they found the plight of in-service doctors irrationally transferred only to cater to the vested interest of few.

OMSA’s Demand to be a partner in State Health Administration, such as occupying the post of Secretary, Special Secretary, Additional Secretary, Joint Secretary of Health; a valid attraction for young Allopathic medicos to pursue a career in Orissa Medical Service, has not gone down well with persons running the show without the expertise and experience of ground realities.

No Cadre rule to govern the OMS Cadre after it became Junior Class 1 at entry-level, even after 20 months as notified by the Health & FW Deptt notification no. MS II IM (Sr.) 12/08-14994 dt. 26.05.2009 “The amendment to the rules regulating recruitment and promotion to the restructured OMS Cadre is under preparation and shall be finalized in prescribed manner within 6 months”.

Regarding vacancies at present in different level of posts after restructuring of OMS Cadre are Junior Class 1 – 658/1158 (Specialist), 576/1076 (Non Specialist), Senior Class 1 – 835/1440, Joint Director Level 2 – 170/452, Joint Director Level  - 50/120, Additional Director – 4/8. Total vacancy is 1967/4258. Maximum number of DPCs held in last 2 years is confined to only top 12 posts. The vacancies in Specialist posts will shoot up after All-India P.G. Examination begins because in-service candidates from the state will fail to qualify in large number due to overburdened preoccupation of plethora of duties.

In 2012, around 900 doctors are going to retire (1978/79 PSC – 150 x 3 Medical Colleges x 3 batches = 1350 doctors) creating an alarming situation in Health sector where the Allopathic doctor actively working manpower has already dwindled to 2000.

In the neighbouring state of West Bengal, Dental Surgeons are posted up to Primary Health Centre (PHC) level since long back, in Orissa only 17 Dental Surgeons posts are there in OMS Cadre to cater to a population of 4.5 crores.

In the meantime, the State President OMSA has written to the Hon’ble Chief Minister and Health Minister of the state to have a free and frank discussion with OMSA Executives over these issues yielded no result.

Therefore, I request you all to air all these issues through your forum as you have done in the past for the greater interest of the people and doctor of the state.

2. Dr. Binod Bihari Rath has not submitted evidence of being a Branch Secretary.

3. Dr. Siba Charan Bagh disqualified due to non-completion of 10 years of service.

4. Dr. Sisir Kumar Pradhan has submitted a certificate that he was the Branch Secretary, Ganjam for the period 2005-07 in a plain paper. He has to produce the certificate in the pad of OMSA within one month from 7.5.09.

5. (A) Dr. Siba Prasad Singh not qualified to contest the election as he was expelled by the General Body on 21.8.08 communicated vide letter No.OMSA/GS/07-09/52 dt-1.5.09 of State General Secretary, OMSA. (B) Valid proof of being Branch Secretary not submitted.

6. Dr. Surya Narayan Behera has also applied for Managing Editor, OMSA Voice at Sl.No.10 since both the posts are member of CEC. He has to resign from one post if elected for both the posts.

7. Dr. Krushna Chandra Mohapatra has not produced proof of OMSA membership. He has to produce proof of membership of OMSA within one month from 7.5.09.

8. Dr. Nirakar Bhatt has submitted the proof of being the Branch Secretary in plain paper. He has to produce the certificate in the pad of OMSA within one month from 7.5.09.

Sir,

     We have gone through the copy of the proceeding of the APPEALING BODY of OMSA held on 29th August 2008, sealing on appeal over the decision taken by the general body with respect to expelling Dr. Siba Prasad Singh from the post of General Secretary and Dr. Jitendra Kumar Ray from the post of Vice President Central Zone and further selecting Dr. Jyoti Prakash Biswal as General Secretary of OMSA on 21st August, 2008.

 

     We are sorry and as well as surprised to know that such a decision has been taken by the APPEALING BODY on 29th August, 2008 & signed by its chairman on behalf of the APPEALING BODY.

 

     There is no mention of the proceedings as to who filed the appeal and on the basis of whose/whom the APPEALING BODY sat and gave the decision on the proceedings as well as who convened the meeting. On the contrary it has been stated that the APPEALING BODY sat on the basis of information reliably learnt by them from the reliable sources.

 

     Sir, we are duty bound and compel to provision of Para 35 of Constitution of OMSA. It is the power with respect to settlement of any dispute to assure its power. There can be dispute with general body has taken a decision and it has been disputed by some members/persons, who have something to say disputing the decision. As it is seen there is no such dispute refer to much less relating to any dispute. Therefore it is much dispute in the eye of the law to assume Jurisdiction under Para 35 of Constitution of OMSA.

 

     Sir, we are to point out the scope of Provision of Para 35 of constitution of OMSA it envisages that it is exclusively to receive appeal & place before the APPEALING BODY. Its duty is to try such disputes for reconciliation. Reconciliation means party taking decision and party objecting to it will be called before the APPEALING BODY and given date and mentioning the subject matter. If the reconciliation fails the APPEALING BODY is only empowered to draw the proceedings and mention the failure of reconciliation. Therefore it works as a reconciliatory authority and nothing more. But under no circumstances it has been empowered to set aside a to declare illegal any such decision of the General Body. Which is above any such body moreover any dispute arising out General body decision can only be rectified in the General Body only.

 

     Sir, it is pointed out that such decision of the APPEALING BODY is against the provision of law without any authority and jurisdiction. Therefore it is abinitio-void. This is for your information and necessary action.
